NYCRR Title 10 Part 4 Replaces NY State Emergency Legionella Laws

New Law Passed for Cooling Tower Owners in New York State!

On July 6th, 2016, New York State adopted a new Part 4 to Title 10 of the New York Code, Rules and Regulations entitled Protection Against Legionella. Officially known as NYCRR Title 10 Part 4: Protection Against Legionella, it is now the definitive regulation governing Legionella prevention in New York. This new legislation closely mirrors NYC’s Title 24 Chapter 8 of the Rules of the City of New York and the New York State emergency legislation that it replaces regarding legionella in cooling towers for all buildings and legionella in potable water systems for healthcare facilities throughout New York State. There are however, some significant additions and changes that NY building owners should be aware of. If you are responsible for a cooling tower in the State of New York, including the five boroughs, you are probably going to want to be familiar with this new law.

New York City and State Cooling Tower Laws & Tower Registration Guide

If you are a building owner in New York operating a cooling tower, you have probably heard all kinds of theories about the "new rules" for maintaining them. As per the new cooling tower laws that were recently passed in both New York City and New York State, cooling towers that exist in the Five Boroughs of NYC must be electronically registered with both the city and state; and with just the state for the rest of counties throughout New York. All cooling towers throughout the entire State of New York were required to be registered through their appropriate websites by no later than September 17th, 2015. There is a New York City Cooling Tower Registration Website and a New York State Cooling Tower Registration Website that have been set up for this purpose. Recent events in New York City have once again brought Legionnaires Disease onto the radar for many facilities throughout the Northeast.  The latest Legionellosis outbreak reported in NYC has been allegedly linked back to an infected cooling tower in the Bronx.  It has been reported that the facility in question is now under the watchful eye of the New York City Health Department.  Legionella in a cooling tower is a serious issue because of how a cooling tower operates; not only does the bacteria thrive in an under-treated environment, but the the tower mechanism itself acts as the perfect way to dispurse the bacteria in water droplets into the atmosphere.  As you can imagine, attorneys have already threatened to bring suit, and facility managers across the New Your City are re-thinking their protocols for dealing with legionella. Many building owners are trying to figure out if they have the best water treatment company in New York working for them.  There is a very good chance that there were steps that could have been followed that would have prevented this unfortunate event; and if the American Society of Heating, Refrigerating, and Air-Conditioning Engineers (ASHRAE) get their way, there soon will be.
