It’s winter in the Northeast and we are running into the coldest months of the year. If you operate a commercial property, now is not a good time to have a boiler failure. If you operate an industrial or manufacturing facility, there is NEVER a good time to lose a boiler! Unfortunately, this a common occurrence throughout the winter months and culprit is very often cold feed water. Monitoring your boiler feed water temperature should be an important part of your daily boiler inspection and should be worked into your overall boiler maintenance program.
There is a potential hidden danger that may be lying in wait in your neighborhood’s hospital, your kid’s school, your town shopping center or even your apartment complex. High pressure boilers deliver hot steam under pressure to be used in comfort heating and manufacturing processes. They are commonly used in hospitals, laundromats, dry cleaners, hotels, and schools; but a poorly maintained or improperly operated boiler has the potential to explode. The bigger the boiler… or the more pressure… the bigger the explosion. A faulty or defective boiler is essentially a small bomb. Some boiler explosions cause substantial property damage. Some are much, much worse. Thankfully, there are regulations in place to protect the public from a catastrophic boiler failure. These regulations vary from state to state, however many of them incorporate some form of periodic boiler inspection as an integral requirement.

One of the most important steps in boiler’s lifetime (regardless of make, model or serial number) is when it goes through its initial startup and commissioning process. When done properly, it sets the tone for the how the boiler will operate during optimum conditions. When done poorly, or not at all, it could lead to immediate and profound problems. In its all-out war against the mighty legionella bacteria, New York has passed sweeping legislation regarding cooling towers over the past year. One of the upcoming deadlines in New York City and State regarding compliance is the portion of the laws that require annual cooling tower certification. In the State of New York, building owners and property managers must annually certify that their cooling towers have been inspected, tested, cleaned and disinfected in compliance with New York State Legionella Law - Part 4 of Title 10: Protection Against Legionella. New York City has their own version of this law that must also be followed by building owner that operate a cooling tower with the five boroughs of NYC; the requirements of which are spelled out in Local Law 77 of 2015 and Chapter 8 (Cooling Towers) of Title 24 of the Rules of the City of New York.

Since the Legionella Outbreak of 2015 in the South Bronx, there has been a lot of confusion over the following topics: What is Legionella and what needs to be done in New York City and New York State to be in compliance with the new cooling tower laws. The City and State laws were recently passed with the intention of preventing the spread of Legionella bacteria through cooling towers. As the agents from the various local health departments throughout New York begin to enforce compliance throughout the state, building owners look to their environmental consultants and water treatment companies for answers. The problem is that the New York City laws only pertain to properties that are located in the 5 Boroughs of NYC and they are slightly different than the laws that pertain to rest of the State of New York. New Law Passed for Cooling Tower Owners in New York State!
On July 6th, 2016, New York State adopted a new Part 4 to Title 10 of the New York Code, Rules and Regulations entitled Protection Against Legionella. Officially known as NYCRR Title 10 Part 4: Protection Against Legionella, it is now the definitive regulation governing Legionella prevention in New York. This new legislation closely mirrors NYC’s Title 24 Chapter 8 of the Rules of the City of New York and the New York State emergency legislation that it replaces regarding legionella in cooling towers for all buildings and legionella in potable water systems for healthcare facilities throughout New York State. There are however, some significant additions and changes that NY building owners should be aware of. If you are responsible for a cooling tower in the State of New York, including the five boroughs, you are probably going to want to be familiar with this new law.

Attention NYC Building Owners!
